Virexo-specific clauses
The following clauses supplement the Terms and Conditions above and describe how Virexo specifically works.
1. Geographic scope
Virexo is offered exclusively to businesses established in the European Union or the European Economic Area (EU/EEA). The business's country must be provided at registration; it is not possible to register with a country outside this area. Virexo reserves the right to refuse registration or to suspend and close accounts relating to businesses established outside the EU/EEA.
2. Demo and activation of AI features
Registration grants access to a free 30-day demo that includes all Virexo features except those based on artificial intelligence. AI features are activated only after subscribing to a paid plan (Business or Business Plus). At the end of the demo period, if no subscription is taken out, the account becomes inactive as set out in the account lifecycle clause.
3. AI features and usage limits
Features based on artificial intelligence (in particular the AI help desk and, on the Business Plus plan, the AI calendar) are available on paid plans. The Business Plus plan includes up to 1,500 AI responses per month. Exceeding this threshold does not trigger any automatic charge: any extension of the limit is handled manually by Virexo. AI-generated responses are a form of automated assistance, may contain inaccuracies and do not constitute professional advice; the user is responsible for checking their content before relying on them.
4. Account lifecycle and data retention
WhatsApp conversations managed through Virexo are retained for the entire duration of the User's active subscription, as they constitute an integral part of the Service and are necessary to provide access to communication history and ensure business continuity. The User retains control over their data at all times and may delete individual messages or entire conversations using the features made available through the Platform, subject to the technical capabilities of the Service and any limitations imposed by third-party providers. Upon termination of the subscription, the account will be deactivated and the data will be retained for a maximum period of sixty (60) days solely to allow possible service reactivation or data export by the User. After this period, all data will be permanently and irreversibly deleted from Virexo's systems unless a longer retention period is required by applicable law. Prior to permanent deletion, a notification will be sent to the email address associated with the account. For Demo accounts, data will be retained for thirty (30) days from activation. This period may be extended by an additional thirty (30) days upon notice to the User. After the retention period expires, all data will be permanently deleted. The User may recover an inactive account by logging in and subscribing to (or renewing) a plan before deletion. The User may also request deletion of their account and related data at any time.
5. Acceptable use and suspension
The user undertakes not to use Virexo for: sending unsolicited messages (spam); unlawful, harassing, deceptive content or content that infringes the rights of others; activities that breach the WhatsApp/Meta terms of use and policies; attempts at unauthorised access, reverse engineering, decompilation or circumvention of security measures, and deliberate overloading of the systems (e.g. automated attacks); reselling, sublicensing or making the service available to third parties without Virexo's written authorisation; any purpose contrary to the law. The user must obtain from their own customers the consents required to send messages and process their data. With respect to such data, Virexo acts as a data processor on behalf of the user, in accordance with the Data Processing Agreement (DPA). In the event of a breach, or to protect security and compliance with WhatsApp/Meta rules, Virexo may suspend or close the account, including without notice in the most serious cases.
6. Third-party services (WhatsApp/Meta)
Virexo integrates with WhatsApp Business, a service provided by Meta and independent from Virexo. Messages are sent and received through Meta's infrastructure and are subject to Meta/WhatsApp's terms, conditions and policies, which the user must accept and comply with. Any messaging fees are set and charged directly by Meta, under its own conditions and in amounts Meta may change at any time; such costs concern the direct relationship between the user and Meta and are not set, collected or guaranteed by Virexo. A Virexo subscription does not include or cover any messaging fees charged by Meta. Virexo is not responsible for changes, suspensions, malfunctions or price variations of Meta/WhatsApp's services.
Data Processing Agreement (DPA)
For the data of your end customers processed through Virexo, the Data Processing Agreement pursuant to Article 28 GDPR applies and forms an integral part of these Terms.
